These Terms of Service ("Terms") govern your access to and use of HireModeler, a service provided by Portrait Labs ("we", "our", or "us"). By using HireModeler, you agree to these Terms.
1. Acceptance of Terms
By accessing or using HireModeler, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the service.
2. Description of Service
HireModeler is a software-as-a-service platform that provides Monte Carlo simulation tools for hiring decision analysis. The service helps engineering leaders model and compare different hiring scenarios.
3. Account Registration
To use HireModeler, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Subscription and Payment
HireModeler is offered as a paid subscription service at $199 per month.
- Free Trial: New users receive a 14-day free trial with full access to all features
- Billing: Subscriptions are billed monthly in advance
- Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period
- Refunds: We offer a 30-day money-back guarantee for new subscribers
5. Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Reverse engineer or attempt to extract source code
- Resell or redistribute the service without authorization
- Use automated systems to access the service without permission
6. Intellectual Property
HireModeler and its original content, features, and functionality are owned by Portrait Labs and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any data you input into the service. You grant us a limited license to use this data solely to provide the service to you.
7. Disclaimer of Warranties
HireModeler is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The service will be uninterrupted or error-free
- Results obtained from the service will be accurate or reliable
- The service will meet your specific requirements
Important: HireModeler provides analytical tools to assist with hiring decisions. The simulations and projections are based on statistical models and user-provided inputs. They should be used as one input among many in your decision-making process, not as the sole basis for hiring decisions.
8. Limitation of Liability
To the maximum extent permitted by law, Portrait Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of HireModeler.
Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Portrait Labs from any claims, damages, or expenses arising from your use of the service or violation of these Terms.
10. Modifications to Service
We reserve the right to modify, suspend, or discontinue HireModeler at any time, with or without notice. We will make reasonable efforts to notify subscribers of material changes.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the service ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
